Regular Board Meeting

CALL TO ORDER
President Dennis Burtness called the meeting to order at 7:00 p.m. Present were President Burtness, David Olsen, Beth Schmidt, Nikki Tuffree, Terry Gerber, and Terry Morris. Also present were Don & Karissa Wendt, Nick Howard, Officer Brad Cheske, Librarian Sarah Strunz, DPW Director Nick Todd, and Clerk Sherri Waege. Absent was Cami Myers-Alstat.
AGENDA VERIFICATION
Clerk Waege verified that on April 12, 2025, copies of the agenda were delivered to the President and Trustees; and posted at the Village Hall, Library, and the Orfordville Post Office. There were no additions made to the agenda.
MINUTE APPROVAL
Motion by Tuffree, seconded by Gerber to approve the minutes of the Regular Board Meeting of March 24, 2025 and Special Board Meeting of March 31, 2025. Motion carried.

NEW BUSINESS
Planning Commission Recommendation for Zoning Change for Don & Karissa Wendt of 118 N. Main Street. Motion by Morris, seconded by Schmidt to approve the Planning Commission recommendation to approve the Zoning Change from R-1 Single Family to R-2 Two Family Zoning for 118 N. Main Street. Motion carried.
Don Wendt asked if he had to have two services as he did not feel the living space in the basement is a separate apartment. Wendt explained that it is very expensive to put in a second service for a space that is only used for family. Wendt further explained that he is waiting for clarification on what services need to be in place.
Don Wendt also brought up other locations in town that he did not feel were in compliance of what was being required of him.
Don Wendt further explained that he was given occupancy on the entire building as the building inspector made him do upgrades in the basement. Clerk Waege explained that the building inspector only gave occupancy for the upstairs apartment, the Wendt’s disagreed.
Don Wendt further explained that he only put up two walls and the space is only used for family. Discussion held on what an apartment is. The Wendt’s were firm that they do not have a second apartment so the R-2 zoning is not necessary.
Clerk Waege explained that she had Wendt apply for R-2 Two Family zoning as he told her he had a second apartment in the basement for family. Clerk Waege explained that a second apartment required occupancy if people were staying there. A second apartment is not allowed in R-1 Single Family Zoning.
Much discussion on if the downstairs living space is considered an apartment.
Motion by Morris, seconded by Schmidt to reconsider the motion to approve the R-2 Zoning Change for 118 N. Main Street as Wendt does not feel the living space is an apartment. Motion carried.
Morris suggested that the building inspector go to the property to determine what has been done since the permit for the upstairs apartment. Wendt requested that a board member be present due to the past history they have with the building inspector. Clerk Waege explained that the building inspector has already stated that he will be bringing another inspector with him due to the past history that he has with the Wendt’s.
Ordinance 34-26A for Heavy Trucks. Officer Cheske was present to explain the Heavy Truck Ordinance that he drafted. Officer Cheske explained that he obtained the information from two other municipalities to write the ordinance. Officer Cheske further added that the ordinance has been reviewed by Attorney Mike Davis. Discussion held on providing maps to local businesses that have deliveries made so they can advise the drivers of the new ordinance.
Motion by Morris, seconded by Gerber to approve the ordinance as amended. Motion carried.
Amendment of Ordinance 14-6 regarding Residency for Appointments and Committees. President Burtness explained that some of the Committee Ordinances do not comply with the residency ordinance. Motion by Morris, seconded by Olsen to amend Ordinance 14-6 as presented. Motion carried.
DEPARTMENT HEAD REPORTS
Motion by Morris, seconded by Schmidt to approve the Department Head Reports. Motion carried.
VOUCHERS
Motion by Tuffree, seconded by Schmidt to approve the vouchers with a check range of 38224-38294. Motion carried.
ADJOURN
Motion by Morris, seconded by Gerber to adjourn at 8:34 p.m. Motion carried.
