CALL TO ORDER

                President Dennis Burtness called the meeting to order at 7:00 p.m.  Present were President Burtness, David Olsen, Beth Schmidt, Nick Howard, Nikki Tuffree, Terry Gerber, and Terry Morris.   Also present were Attorney Tim Lindau, Tayna Burtness, Chief Jeremiah Burdick, DPW Director Nick Todd, and Clerk Sherri Waege.

AGENDA VERIFICATION

                Clerk Waege verified that on February 20, 2026, copies of the agenda were delivered to the President and Trustees; and posted at the Village Hall, Library, and the Orfordville Post Office.  There were no additions made to the agenda.

MINUTE APPROVAL

                Motion by Morris, seconded by Howard to approve the February 9, 2026 minutes.  Motion carried.

CITIZENS WISHING TO BE HEARD

NEW BUSINESS

                Street Closures for 2026 Market Day Events.    Tayna Burtness, of 300 Clark Street was present to request the closure of a portion of Dickson Street for the Market Day Events in 2026.  Motion by Morris, seconded by Gerber to approve the street closure request for a portion of Dickson Street for the Market Day Events on May 9, June 13, July 11, August 8, and September 12, 2026.  Motion carried.

                Approval of Zero Lot Line Covenants for Lot 38 of Mill Valley Subdivision.  Motion by Gerber, seconded by Morris to approve the Zero Lot Line Covenants for lot 38 of the Mill Valley Subdivision, as required by the Developer’s Agreement.  Motion carried.

                Stormwater Pond at Mill Valley Subdivision.  Attorney Lindau explained that he will draft the deed to deed the pond to the Village, upon the pond being cleaned out and restored by Next Generation Construction.  No action taken.

                Parcel 6-24-175.903.01 Playground Lot at Haugen Park on Colby Drive.   Attorney Lindau explained that this parcel has remained in Next Generations name since the three lots were developed at the end of E. Church Street.   Attorney Lindau will draft the deed to get the parcel deeded to the Village.  No action taken.

                Amending of Developers Agreement for Rime Ridge.  Attorney Lindau explained that the Developer Agreement requires  $10,000.00 be paid to an escrow account for engineering and legal expenses.  Zach Knutson of Next Generation Construction requested that the Developers Agreement be amended so that rather than pay the $10,000.00 into an escrow account, he be able to pay the fees as they are charged.   Attorney Lindau will draft the amendment.  No action taken.

                Stormwater Pond at Rime Ridge Subdivision.  Attorney Lindau explained that he recommends the Developer Agreement be amended to allow for the Village to maintain the stormwater pond.  The current agreement allows for Next Generation to own it.  The approved Covenants will need to be amended as they  include HOA fees for the residents to pay to maintain the pond. Attorney Lindau will amend the Developers Agreement to allow for Next Generation Construction to deed the pond to the Village after construction and to have the pond cleaned and restored prior to the deed being granted.  No action taken.

                Letter of Credit in Rime Ridge Subdivision.  Attorney Lindau explained that the Developer’s Agreement can be interpreted differently in regard to the return of the original Letter of Credit.  Clerk Waege explained that she was holding the Letter of Credit as  the Developer’s Agreement states the Letter of Credit shall not be returned until the improvements are accepted by the Village, which has not taken place.   Additional discussion held.  Attorney Lindau explained that he felt the Letter of Credit could be exchanged at this point.  Clerk Waege will reach out to Knutson to let him know.   No action taken.

TREASURER REPORT

                Motion by Tuffree, seconded by Gerber to approve the January Treasurer Report.  Motion carried.

VOUCHERS

                Motion by Morris, seconded by Schmidt to approve the vouchers with a range of 39484-39527.  Motion carried.

VILLAGE PRESIDENT’S UPDATE

            All local restaurant menus are now on the village website under the Shop – Eat – Play – Service tab.   https://orfordvillewi.gov/ .
