CALL TO ORDER

                President Dennis Burtness called the meeting to order at 7:00 p.m.  Present were President Burtness, David Olsen, Beth Schmidt, Nick Howard, Nikki Tuffree, Terry Morris, and Tory Baars.  Also present were Attorney Bryce Becker, Attorney Mike Davis, Tayna Burtness, Kirk and Sue Douglas, Mike Eggleston, Janet Rains, Laura Worachek, Ryan Akkerman, Brett Arnold, Chief Jeremiah Burdick, and Clerk Sherri Waege.

AGENDA VERIFICATION

                Clerk Waege verified that on April 24, 2026, copies of the agenda were delivered to the President and Trustees; and posted at the Village Hall, Library, and the Post Office.  There were no additions made to the agenda.

MINUTE APPROVAL

                Motion by Tuffree, seconded by Morris to approve the following minutes:  April 8, 2026 Special Board Meeting, April 13, 2026 Regular Board Meeting, and Annual Organization Meeting of April 21, 2026.  Motion carried.

CITIZENS WISHING TO BE HEARD

                Mark Zindran Rhodes of 308 E. Spring Street was present regarding the Bee Keeping item on the agenda.

                Janet Rains of 3432 S. Old Highway 11 was present regarding the drainage problems on Old Highway 11.  Rains explained that the new Rime Ridge Subdivision has created additional runoff on Old Highway 11 and is causing property damage and additional damage to the road.  Rains further explained that she has spoken with Nick Todd of Next Generation Construction who assured her that it would be taken care of.    Rains explained that she is not sure who the contact is for the road as the road is located in the Village, the Town of Spring Valley, and the Town of Plymouth.   Rains explained that she appreciates the Village maintaining the road in the winter months.  Schmidt suggested that we talk with Steve Hazeltine and Don Bomkamp from the Towns to discuss road maintenance due to the deterioration of the road.

                Kirk and Sue Douglas of 10714 W. Welsch Road were present regarding the flooding on Old 11.  Sue Douglas explained that the run off is much worse since the subdivision started.  Kirk Douglas asked where all the water from the subdivision is supposed to go, as he is having drainage issues down the road.   President Burtness explained that he will talk with Next Generation to see what the intention is for drainage from the subdivision, after the water leaves the pond.

NEW BUSINESS

                Bench donation from the Parkview Community Foundation.  Schmidt explained that the Parkview Community Foundation would like to donate a composite bench to Purdy Park.  Tayna Burtness explained that the Foundation would like the bench in a busy location to get their name out to the community.  Schmidt explained that the Foundation will donate $1,200.00 for the bench, the Lions Club will pay the overage if the cost exceeds $1,200.00.   Discussion held on locations, as there are several benches at Purdy Park now.   Schmidt will talk to the members of the Foundation to let them know that they would like the bench to be at Willow Park, the Village owned lot downtown, or Purdy Park.  No action was taken.

                Sale of Freezer at Brat Stand.  Tayna Burtness was present regarding the chest freezer in the brat stand.   Tayna Burtness explained that the freezer has been there for many years and has hardly been used.  Tayna Burtness further explained that the chest freezer also takes up a lot of space in the building.  Tayna Burtness would like to sell the chest freezer and purchase a refrigerated cooler, which would be used much more.  Tayna Burtness felt that the Village could easily get $200.00 for the freezer and suggested that it be listed on the Only in Orfordville Facebook page.  Baars explained that she will be having  a rummage sale this weekend and would be willing to have it there to sell.   Motion by Morris, seconded by  Howard to approve the sale of the chest freezer in the brat stand  with the proceeds to be used towards a refrigerated cooler for use in the brat stand.  Motion carried.

                Bee Keeping Ordinance in Residential Zoning.  Mark Zandran Rhodes of 308 E. Spring Street was present.   Rhodes provided the Village Board members with documentation regarding bee keeping in residential neighborhoods.   Laura Worachek from the Rock County Bee Keepers Club was also present.   Worachek explained that bee keeping is getting popular, much like having back yard chickens.  Worachek further explained that back yard bee keeping should be limited to two hives, have a water source, have strict guidelines, and respect for neighbors.   Worachek explained that honey bees are not typically the type of bees that will sting.  President Burtness explained that he did some research and explained that people that have bees have to register with the state.   Motion by Schmidt, seconded by  Tuffree to have the Planning Commission research and create an ordinance for public hearing.  Motion carried.

                Ordinance 26-2 Amendment regarding Municipal Judge Election.  President Burtness explained that Ordinance 26-2 states that the judge is elected in an odd year for a four-year term.  President Burtness further explained that the Village’s Municipal Judge serves a four-year term that is effective in even years.   President Burtness explained that the State Statute does not specify if the term has to be elected in an odd or even year.   Motion by Tuffree, seconded by Baars to amend ordinance 26-2 by removing the language stating that the judge is elected in an odd numbered year.  Motion carried.

                Ordinance 26-4 Amendment regarding Court Cost for Citations.  Chief Burdick explained that the amendment would increase the court cost for citations from $38.00 to $48.00 to follow state statute.  Attorney Becker asked if the bond schedule would be updated.  Chief Burdick explained that it will be updated if approved.   Motion by Morris, seconded by Baars to amend Ordinance 26-4 by raising the court cost from $38.00 to $48.00.  Motion carried.

                Amend Developers Agreement for Mill Valley Subdivision.  Attorney Mike Davis explained that the amendment is to convey ownership of the stormwater detention pond to the Village, upon silt removal in the pond 120 days after the final occupancy permit is granted.   Akkerman asked if we are required to accept it.   Attorney Davis explained that yes, municipalities maintain ownership of residential ponds.  Arnold explained that the posts are still in place from when they cut the post to remove the subdivision sign, Arnold would like the posts removed for mowing.    Clerk Waege will contact Next Generation to have them finish the removal of the sign post.  Motion by Morris, seconded by Howard to approve the 2nd amendment of the Mill Valley Developer’s Agreement with the change that the silt removal inspection will be conducted by the Village Engineer and to require restoration of the parcel after maintenance is complete to it’s condition prior to silt removal.  Motion carried.

                Amend Developers Agreement for Rime Ridge SubdivisionSidewalk- President Burtness explained that at the Planning Commission and Village Board meeting for plat approval,  discussion was held on requiring a sidewalk between Lots 16 and 17 to access Old Highway 11.  President Burtness did explain that the easement is in place, but Next Generation has confirmed that they do not intend to put the sidewalk in.    Board Members and Planning Commission members present confirmed that it was discussed and agreed to at both meetings; however, it was not put in the Developer’s Agreement.   President Burtness explained that he contacted Mike Eggleston to get a verbal estimate on the sidewalk.   Mike Eggleston explained that he measured it and it is approximately 215 feet in length and will also require a culvert for drainage.  Olsen asked Eggleston for a ball park price for the project.  Eggleston estimated it at $15,000.00.   The board would like the Developer’s Agreement amended to reflect the conversations that were held upon Final Plat Approval when the sidewalk was discussed and agreed upon.  Reimbursement Fund-   Clerk Waege explained that the first payment request was paid within the 15 days; the second payment request was due on April 10th and has not yet been received.  Clerk Waege will send a reminder email.   Conveyance of Playground Parcel-  No Discussion was held.  Conveyance of Stormwater Detention Pond-   Olsen explained that he is not in favor of any changes to the Detention Pond portion of the agreement until the drainage issue on Old Highway 11 is fixed.  Discussion held on the water problem from when the detention pond drains into the ditch and properties on Old Highway 11.   President Burtness will contact the Village Engineer to have him come to the site to see what his recommendation is for correcting the water drainage so it does not damage neighboring properties.   No action was taken on approval of the Amendment to the Developer Agreement for Rime Ridge Subdivision.

                Ordinance Amendment 17-12 and 17-13 for Bidding Requirements.    President Burtness is working on the amendment and would like to clarify a couple things before it is ready for approval.  Motion by Morris, seconded by Tuffree to table to the May 26, 2026 meeting.  Motion carried.

                Amend Resolution R-2026-01 Full Time Public Works Wage Increase.  The DPW Committee has not made a recommendation on increases.  No action was taken.

TREASURER REPORT

                Motion by Morris, seconded by Tuffree to approve the Treasurer Report.  Motion carried.

VOUCHERS

                Motion by Tuffree, seconded by Howard to approve the vouchers with a check range of 39996-40091. Motion carried.

VILLAGE PRESIDENT’S UPDATE

                President Burtness updated those present on the following:

                May 9th

  •        First market May 9th at the Market Lot from 9-1 pm.

  •        Electronic Recycling right here in the Village Parking Lot 9-11 am

  •        Ribbon Cutting for Body Balance at 9:30

  • Great business after 5, thank you to the Economic Development and Knutes 

  • May 4th summer school registration opens at Parkview 

  • Congratulations to Mr. TJ Sattler on the 2026 Herb Kohl Teacher Fellowship Award 

  • Rummage sales next weekend and plans to have one in the fall now too.

On May 22, our students will be participating in a special Day of Giving, where they will serve and give back to our local communities across our nine municipalities.
We are looking for meaningful, hands-on service projects where students can lend a helping hand. Projects should be appropriate for students and able to be completed in approximately 3 hours or less.
Examples might include:

  • Raking leaves or yard clean-up

  • Pulling weeds or gardening

  • Painting fences or small structures

  • Light outdoor clean-up or beautification projects

  • Beth, could they help with planting the flowers in the planters? 

  • It would be great if they could do some weeding at Village Hall

If you, your organization, or someone in the community has a project that could benefit from student volunteers, we would love to hear from you!

Thank you to the Public Works and Police Department for the extra hours worked during the storm event on Friday, April 17th.   Ryan Akkerman, Brett Arnold, Chief Burdick, and Officer Cheske all stayed late to make sure things went smoothly.
